1. Agreement to Terms

By accessing or using the Visuall AI platform ("Service") at visuall.ai, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of the Service

Visuall AI is an AI-powered image generation platform that transforms text narratives into visual content packs. The Service uses artificial intelligence models to generate images based on user-provided prompts and instructions. Results may vary and are dependent on the input provided and the capabilities of the underlying AI models.

3. Account Registration

To use certain features of the Service, you must create an account. You may register using an email address and password or through Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information and promptly update it if it changes. We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Credits and Payments

The Service operates on a credit-based system. Credits are required to generate images and are consumed based on the AI model selected and the number of images generated.

Credit Packs: You may purchase one-time credit packs at the prices listed on our pricing page. Credits from packs do not expire.

Subscriptions: We offer monthly subscription plans that include a recurring credit allowance. Subscription credits reset each billing cycle. Subscriptions automatically renew unless cancelled before the next billing date.

Free Credits: New users may receive complimentary credits upon registration. These are subject to the same terms as purchased credits.

Payments: All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are displayed in US dollars and are inclusive of applicable taxes unless otherwise stated.

5. Refund Policy

Due to the nature of digital services and AI-generated content, all purchases are generally non-refundable once credits have been used.

We may issue refunds at our discretion in the following cases:

  • Technical failures on our end that prevented image generation
  • Duplicate charges or billing errors
  • Unused credits from cancelled subscriptions (prorated at our discretion)

To request a refund, contact us at support@visuall.ai within 14 days of the purchase.

6. AI-Generated Content and Intellectual Property

Your Content: You retain ownership of the text prompts and narratives you submit to the Service.

Generated Images: Subject to these Terms and your active account standing, you are granted a license to use, download, and commercially exploit the images generated through the Service. The specific usage rights depend on your subscription tier.

Limitations: AI-generated images are created using machine learning models and may not be eligible for copyright protection in all jurisdictions. We do not guarantee exclusivity — similar prompts from different users may produce similar results.

No Guarantee: We do not guarantee that generated content will meet your specific requirements, be free from artifacts, or be suitable for any particular purpose.

7. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Generate content that infringes on the intellectual property rights of others
  • Generate content depicting real individuals without their consent
  • Attempt to reverse-engineer, decompile, or extract the AI models used by the Service
  • Use automated systems (bots, scrapers) to access the Service without our written consent
  • Circumvent credit limits, abuse free credit offers, or create multiple accounts to gain unfair advantage
  • Resell access to the Service or credits without authorization

We reserve the right to suspend or terminate accounts that violate this policy, without refund.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We rely on third-party AI model providers, and changes in their availability or terms may affect our Service. We are not liable for any losses resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Visuall AI and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Any unused credits may be forfeited upon termination, except where prohibited by applicable law.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
